Website Terms of Use

Welcome to the Lakefield College School website (the “Website”). Access to the public content and services of the Website is generally available, while access to the private content and services of the Website is provided to you, if you are a student, an alumnus, a trustee, a faculty or staff member, a parent of an enrolled or former student, or in some cases if you are a relative, guardian or consultant for an enrolled student.

The Website is primarily designed to help maintain the relationship between you and Lakefield College School (the “School”). Some modules of the Website have more specific purposes, such as the eRegistration system which is designed to simplify the process for securely gathering personal information and consent with regards to students and the services offered by the School; or the Learning Management System, Edsby, which is designed to provide detailed personal academic information for current students and their parents.

Your use of the Website is subject to the terms of these Website Terms of Use (the “Terms of Use”), as well as the School’s Privacy Policy, and any other relevant terms and conditions pertaining to the Website or a specific module or section of the Website (“Additional Terms”) that the School may from time to time incorporate as part of this agreement. Please read these documents carefully before using the Website or any of its functions. Use of the word “party” or “parties” refers to you or the School or both, as the context requires.

Accepting these Terms of Use

Your use of the Website signifies your agreement with these Terms of Use including any Additional Terms. If you do not agree, either now or in the future, with any of the Terms of Use or Additional Terms, you may not access, link to, or use the Website. The School reserves the right, at its sole discretion, to modify, alter or otherwise update these Terms of Use and to impose Additional Terms at any time and you agree to be bound by such modifications, alterations or updates as a condition of accessing, linking to and using the Website.

Private Access

Access is granted to the private content and services of the Website via a unique username and password (an “Account”). You agree to ensure that your actions while using your Account will be reasonable. You agree to be fully responsible for any and all use of your Account, regardless of whether the use is unintentional or unauthorized. The School does not allow anyone but the person assigned the Account by the School to use the Account. You are responsible for preventing such unauthorized use, including protecting and keeping confidential your Account username and password. Access to some modules of the Website are dependent on your role in the community, and as such access may be granted or revoked if your role changes. The School reserves the right to revoke access to the Website at any time, if you do not comply with these Terms of Use. Access to the Website may be restricted by the School at any time for any reason, but most typically for the purpose of maintenance.

Restrictions on Use

In accessing, linking to, or using the Website, you agree to not knowingly:

  1. use any device, software or technique to interfere with or attempt to interfere with the proper working of the Website, or with the Website access granted to you;
  2. post or transmit to the Website any unlawful, fraudulent, harassing, libellous, profane, or obscene information of any kind;
  3. post or send to the Website any information that contains a virus, bug, or other harmful item;
  4. post or transmit into or on the Website any information in violation of another party’s copyright or intellectual property rights;
  5. take any action which imposes an unreasonable or disproportionately large load on the School’s or its service provider’s infrastructure;
  6. use any device or technology to provide repeated automated attempts to access private portions of the Website; or,
  7. use the Website for the promotion of any private business or enterprise.

Creating Content

By posting, publishing, uploading, or distributing any messages, data, information, text, graphics, links, content, or other materials (collectively, “Postings”) via or for use on the Website, you grant (or warrant that the owner of such rights has expressly granted) the School a perpetual, worldwide, royalty-free, irrevocable, non-exclusive right and license, with the right to sublicense, to use, reproduce, modify, adapt, publish, publicly perform, publicly display, digitally display and digitally perform, translate, create derivative works from and distribute such Postings or incorporate such Postings into any form, medium, or technology now known or later developed anywhere. You agree that you shall have no recourse against the School for any alleged or actual infringement or misappropriation of any proprietary right in Postings you provide to the School.

By creating Postings, you agree that you do so at your own risk, and understand that the School does not guarantee that Postings will not be viewed by unauthorized users. You understand and acknowledge that, even after removal, copies of your Postings may remain viewable in cached and archived pages, or if other visitors to the Website have copied or stored your Postings.

Information Collection

The School may collect user information from the Website (for example, via a username, an IP address or cookies, which are alphanumeric identifiers transmitted from our website to a visitor’s browser and then back to our website unchanged). This information is used to provide you with a customized online experience and to find ways to improve our site. Although cookies are widely used, it may be possible to disable cookies via your browser settings. However, if you do, the Website may not function properly or optimally.

The Website allows you to enter personal information, for example, to inquire about admission, to post a profile, or to send messages. Your provision of such information constitutes your agreement to allow the School to use the information to provide the services of the Website and to maintain our relationship with you.

Information Collection by the eRegistration System

One of the purposes of the eRegistration System module of the Website (typically used by parents of enrolled students), is to gather personal information with regards to students and the services offered by the School. As such, when using the eRegistration System, you agree to the collection, storage and use of this information including its use by third parties in certain situations. Most of the information is for internal use by the School, but as noted in various parts of the eRegistration System, some of the information may be shared with health insurance providers, government agencies, banks, other schools, health care professionals and other third parties. If you have any questions about what specific information will be shared, please contact the individual or office listed on each document presented by the eRegistration System.

When using the eRegistration System, you agree also to provide true, accurate, current and complete information on all documents presented by the eRegistration System, and to promptly update the School as necessary to keep the information true, accurate, current and complete during the time at which the student listed on the documents is enrolled with the School.

Signatures Collected by the eRegistration System

Another purpose of the eRegistration System module of the Website (typically used by parents of enrolled students), is to collect your consent, permission and agreement on electronic documents. You agree that the signature affixed to electronic documents in the eRegistration System by a user of your Account constitutes proof that you have signed the document and entered into a binding agreement with the School. That signature may take the form of entering the word “agree” or “yes”, or clicking “I Agree” or some similar mechanism contained in the user interface of the eRegistration System. You agree to be fully responsible for all obligations arising from and any damages occasioned by the use of your Account, regardless of whether the use was intended or authorized by yourself.

To help ensure your identity is secure, and any use of the eRegistration System is authorized by yourself, your username is linked to one email address (“Linked Email”). All documents completed online are sent to this email address for your records. If you feel a document has been completed in error, please contact the Admissions Office within 24 hours.


As a user of the Website, you agree that you are responsible for managing the security and privacy of any computers and Internet software you use to access the Website, and, for eRegistration System users, the security and privacy of your Linked Email account. If given an Account, you agree also to maintain the confidentiality of your Account password, and to send notice to the School within 24 hours if your password is compromised. As a user of the Website, you acknowledge that the Internet is a worldwide network of computers, and that while information is encrypted by your Internet browser before transmission to many modules of the Website, it must necessarily route via third-party computers to the School, and as such, the School is not responsible for lapses in online security and does not assume liability for damages or loss of privacy occasioned by any breaches in security.

Right to Regulate

You acknowledge that the School has the right, but no obligation, to monitor the Website and Postings made by users on the Website or to disclose any information necessary to operate the Website, in order to protect the School, third parties, or members of the School’s community, and to comply with legal obligations or governmental requests. The School reserves the right, in its sole and absolute discretion, to monitor and edit Postings, remove them, and cause them not to be posted, published, uploaded or distributed at any time and for any reason or no reason. The School reserves the right to refuse to post or to remove any information on the Website, in whole or in part, for any reason. The School reserves the right to change the Website at any time at its sole discretion without notice to users. The School may deny access to the Website to anyone at any time for any reason whatsoever.

Compliance with Law

You agree to comply with all governmental laws, statutes, ordinances, and regulations regarding your use of the Website. You may not use the Website to do business with the School if you are not of legal age to form a binding contract with the School. You may not use the Website if you are a person who has been barred by the School from using the Website or who is otherwise disqualified from using the Website under the laws of Canada or other countries (including the country in which you are resident or from which you use the Website).

Governing Law

The School operates and controls the Website from its offices within the Province of Ontario, Canada. The Website can be accessed from all provinces and territories of Canada and likely from other countries around the world. As each of these jurisdictions has laws that may differ from those of the Province of Ontario, these Terms of Use shall be governed by, construed, interpreted, and enforced in accordance with the laws of the Province of Ontario and the laws of Canada applicable in Ontario. Each of the parties irrevocably submits to the exclusive jurisdiction of the courts of Ontario. Neither party will oppose the enforcement against him, her or it in any other jurisdiction of any judgment or order duly obtained from an Ontario court respecting these Terms of Use. Any action you, any third party or the School bring to enforce these Terms of Use or in connection with any matters related to the Website shall be brought only in the courts of the Province of Ontario, and you expressly consent to, and do not and will not oppose, the jurisdiction of said courts.

Limitations on Use

No portion of the contents accessible through the Website (collectively the “Content”) may be transmitted, transcribed, reproduced, stored or translated into any other form, without the prior written permission of the School. However, you may display portions of the Content on your computer, and may print, download and use portions of the Content, provided that it is for personal information or study only. The School disclaims any and all liability for any consequences which may result from any reproduction or use of any portion of the Content whatsoever.

No other use is permitted. Without restricting the generality of the foregoing, you may not make any commercial use of the Content, or include the Content in or with any product that you create or distribute, or copy such content onto your own website or the website of a third party. You will not link to any of the Content in such a way that the material is not obviously a part of the School’s Website, or in any way that modifies the Content or its presentation including framing the Content.


The Website and the Content are provided “as is”, without warranty, condition, representation or endorsement of any kind whatsoever. Without limiting the generality of the foregoing, the School makes no warranty as to the accuracy, quality or completeness of the information, nor to non-infringement nor to the absence of any software virus or other harmful component on the Website and disclaims all warranties implied by law or applicable statute. You assume all responsibility and risk for your use of the Website and its content and assume sole responsibility to evaluate the accuracy, completeness and usefulness of the content and other information provided.

Your use of hyperlinks to other websites that may be contained in the Website is a free service offered to you by the School. The School neither controls nor monitors these hyperlinked websites. Accordingly, these hyperlinks are provided by the School without warranty, condition, representation or endorsement of any kind whatsoever. The listing of or hyperlinking to an organization on the Website shall not be construed as an endorsement of its services or products, and the School will not be responsible for any losses suffered by visiting the websites of such organizations or in relying upon the information contained therein or the services provided in such sites.

No Damages

In no circumstances shall the School and/or its subsidiaries or affiliates, or their respective directors, officers or employees, be liable for any direct, indirect, incidental, special, punitive or consequential damages that result in any way from your use of the Website or the Content or from your accessing the Website over the Internet or your reliance or use of information or services provided through the Website, including its hyperlinks or any hyperlinked websites.

Entire Agreement

These Terms of Use, together with the School’s Privacy Policy, and Additional Terms constitute the entire agreement between you and the School relating to the matters contained herein and in the School’s Privacy Policy, and Additional Terms.


If any provision of these Terms of Use is found by a court of competent jurisdiction to be unlawful, void, or for any reason unenforceable, the remainder of these Terms of Use shall continue in full force and effect.
